Two Turkish cousins defrauded a Swiss insurance giant: Company files 'debt' lawsuit after 15 years
V. G. C. d A. S., one of Switzerland's century-old insurance companies, filed a lawsuit on the grounds that it was defrauded by 2 cousins of Turkish origin. The company filed a lawsuit for a receivable amounting to 10 million liras.
According to the lawsuit filed at Istanbul 13th Civil Court of First Instance, H. T., who lives in Hamburg, Germany, decided to come to Turkey in 2009 to spend his annual vacation.
According to the news reported by Halktv, H. T., who was about to leave for his hometown Derebucak district of Konya after taking his leave from the institution where he worked, was called by his uncle E. T., who lives in Switzerland and was on vacation in Manavgat district of Antalya at the time.
After landing in Antalya by plane, H. T. went to Manavgat to pick up his cousin E. T. with the car he rented at the airport. H. T. picked up E. T. and one other person and set off for his hometown Derebucak.
CAR WITH 3 PEOPLE INVOLVED IN ACCIDENT
H. T. was sitting in the driver's seat, E. T. in the back seat and E. T.'s friend in the front passenger seat when the car allegedly went out of control on a gravel road in Gembos locality of Konya's Ibradı district. H. T. lost control of the steering wheel and the car rolled into a ravine.
In the accident, H. T. and the passenger in the front seat survived with minor injuries because their seat belts were fastened, while E. T., who was not wearing a seat belt in the back seat and was asleep during the accident, was injured.
Health and police teams were dispatched to the area upon the report of another driver passing by the scene.
E. T., who was hospitalized, was discharged after treatment on the same day.
LAWSUIT FILED AFTER 15 YEARS
About 15 years after the accident, a lawsuit was filed against H. T. and his cousin. V. G.C d A.S. brought the case. The insurance company sued for 251,633 Swiss francs, in other words 9 million 855 thousand TL.
The reason for the lawsuit is that E. T. defrauded the insurance company in Switzerland by pretending to have had a serious accident in order to retire.
"HE SURVIVED THE ACCIDENT WITH BRUISES"
H. T., whose statement was taken within the scope of the case, stated that no accident report was kept regarding the accident that occurred in 2009, that E. T. survived the accident in a light way and that the insurance company was right.
ALLEGATION OF "PLAN TO RETIRE"
Speaking about the process after the accident, H. T. said that E. T. said in a conversation, "This is the opportunity. I will make use of this, I want to retire," and that he was planning to retire from Switzerland using the accident as an excuse.
H. T. claimed that E. T. then phoned the insurance company in Switzerland and told them about the incident and that these calls continued for several days. H. T. said that he was transferred to Switzerland by ambulance and private plane that came from Switzerland to Konya.
HE ARGUED THAT HE WAS VICTIMIZED
At the end of his testimony, H. T. argued that he was victimized by this payment, even though it had nothing to do with him, and that the case should be closed in his favor.
